Victory Australia is the only remaining existing legal action that is capable to prevent the coal, gas, uranium and dirty industry expansion in Australia through the world's highest court, as the national legal challenges have failed to stop the mines that will destroy the Great Barrier Reef.  

 

Currently under review by the International Criminal Court, a unique legal argument authored by Miriam Clements, is now the only international legal action with the power to protect the Great Barrier Reef against the immediately threatening industrial destruction that threatens an ecosystem that sustains the life and economy of millions. 

 

This legal context effectively criminalises climate change in a game changing interpretation of existing law and before Clements identified this interpretation of existing law, no known international law offered populations such essential protection.  This is unexpected genuis that this law has been indentified and the fight to bring this law to life has already spanned 6 years.

 

A successful prosecution would shift investment toward clean energy as political, corporate and investment decision makers would face personal criminal liability - of up to 30 years to life imprisonment and full personal financial forfeiture - for deliberately inflicting the ‘Environmental Destruction’, when they are aware that their conduct is ‘calculated’ to bring about the ‘Physical Destruction’ of the population.

 

 

WHATS NEXT?

 

Our current challenge is to submit an updated evidence profile to to the International Criminal Court that would compel it to transition the case from reviews that have evolved since Clement's 2015 and 2016 submissions, into a formal investigation and trial for late 2017, in time to stop the industrial developments that threaten one of the seven natural wonders of the world.

 

Clements has applied this existing law to protect populations, in this world-first legal argument against ‘Environmental Destruction’ in seven cases that have been accepted by the I.C.C. for review since 2013.

 

Simultaneously she has advanced extensive lobbying to gain international support for this legal application at the highest levels of power and privilege.  

 

Finally in late 2016, after six years of her focus on developing this legal interpretation, the International Criminal Court announced to all countries that they will now prosecute the crime of ‘Environmental Destruction’, thus validating Clement's work and establishing the basis from which this Australian case could be a successfully prosecuted, if a new submission is developed with unity, budget and immediacy to demand this prosecution.

 

The International Criminal Court has the power to issue an interlocutory order to prevent the transfer of 1 billion of Australian public funds to Adani in July and prevent the advance of the Adani, Alpha and all coal, gas fracking and uranium developments that pose risk to the health of Australians and the Great Barrier Reef.   

 

The court additionally has the power to redirect the personal and related finances of those criminally liable for the industrial destruction that has contaminated Australia and bought about the extreme climate related catastrophies, in order to afford the restoration of the Great Barrier Reef and to finance the transition of Australia to clean energy and sustainable industry practice.  This redirection of wealth from those who have profited from destruction, to afford the sustainable transition that will permanently protect the population from any further Environmental Destruction, is a logical equation that current law supports. 

 

Two of the accused, alledged of this crime are Gina Rinehart and Gautam Adani, whose personal wealth alone amounts to 17 + billion dollars.  This wealth could be seized by the court to generate a 17 + billion dollar budget for the sustainable transition of Australia and the restoration and recovery of the Great Barrier Reef. 

 

Victory Australia intends that the new evidence profile will focus on 10 key accused, which amounts to a significant potential sum for future clean industry investment.  Furthermore, this case has the power to protect the Great Barrier economy worth 5.4 billion and the agriculture economy of Australia, worth 54 billion.

 

The campaign is currently looking to secure the development finance for the new court submission in a timely manner, in order to compel the interlocutory order before July.

 

Clements is working with the Environmental Defenders Office, other independent lawyers, Barristers and QC's, along with a range of the worlds top marine scientists to develop the next submission to the court, hoping to have this made before July end.  Clements has been in Australia speaking at events to raise awareness for this action from January to April.  She continues to be focused on engaging Australia's leading scientists, lawyers and environmentalists to contribute toward the next update to the court so that it is strong through a unified front.  Simultaneously she has been developing the Victory Australia public campaign with a team who are working full time on engaging support from public figures and raising awareness among citizens.

 

Clements original argument to defend Australia’s ecosystem and the Great Barrier was placed with the court and Her Majesty the Queen on September 8th, 2016, arguing the necessity to remove Tony Abbott from office or the Governor General would be criminally liable for the conduct of the crime, as the highest legal authority in Australia.  Within a week, on September 14th, Tony Abbott was indeed removed as Prime Minister, in the same hour that the International Criminal Court case accepted the argument for review.  This delayed the case development till after the 2016 election.  International Criminal Case Original Review Confirmation: www.profile.sustainablequalitypremium.com/International-Criminal-Court-Review-SQP-ICC-Australia-case-EM_Ack_OTP-CR-313_15.pdf

 

There is no other existing legal action capable to stop the industrialization that will kill the Great Barrier Reef and extensively contaminate Australia.  This court can prevent the conduct of the crime and holds the power to protect.  The Victory Australia public campaign and legal case could substantially change the future of Australia.
