ABANDON BELO MONTE

 

Article 25.f of the ICC Rome Statute profiles

that if a person abandons the attempt to commit the crime or otherwise prevents the completion of the crime voluntarily & completely, then they shall no longer be liable for punishment.

 

Therefore, the Victory Amazon campaign has the unique opportunity to inspire parties involved to abandon their investment & construction in the Belo Monte, Tapajos & other hydrodam's, which will cause the effective genocide of the indigenous people by contaminating the resources that sustain their life in the jungle. Those individual decision makers who do not abandon will still remain criminally liable for their "attempt" to commit the crime, even if the dam finally fails to progress.

 

 

TO PROTECT the ENVIRONMENT. The catastrophic construction of 60 - 140 hydrodams like the Belo Monte hydrodam, which is currently constructed & planned for Brazil's Amazon rivers, are not only a war against the indigenous people & an illegal expropriation of their lands; 

This represents the fight for an 

ecosystem that provides 20% of the worlds oxygen; 20% of the worlds fresh water, "the worlds most critical finite resource" according to the United Nations; The rainforests are the origin for 25% of our precious medicinal plants & home to 33% of the worlds species, including the white cheeked spider monkey & black cheeked saki monkey.   The South American rainforests, 60% of which are located in Brazil, are crucial to our earth for nature's balance.   This is a land which every person should be demanding to be protected.

 

 

 

 

 

Evidence of Urgency...

 

 

An urgent International Criminal Court 

'Prevention of Genocide' prosecution could prevent the final act of genocide against the 40,000 + indigenous, river & urban populations affected by the Belo Monte hydro dam.


The final execution licenses have been granted by IBAMA, the environmental agency in Brazil, allowing the complicit company decision-makers to embark on the most significant act of construction for the Belo Monte dam, which will constitute the major act of genocide.

 

This license will allow the company directors to order the construction of artificial water canals to begin. These canals will block & divert the river flow, drying the Xingu river's big bend area where the indigenous tribe’s live.

•    This will kill all the fish in the river which will deprive the tribes their primary food source

•    It will contaminate the water so the tribes will no longer have access to clean water & will instead have dry, rotting rainforest creating a rampant environment for water borne diseases such as Malaria & in time, it will force their relocation.

•    It will dry the river, so the tribes will no longer have access to the river for transportation to the city to trade & get medical attention.

International Criminal Court Jurisdiction...

 

The ICC can assume jurisdiction to open a prosecution and charge the individual decision makers responsible, due to the failure of the Brazilian Judicial System to uphold international and local laws, conventions & guidelines, which would have prohibited this dam.  Brazil has ratified the Rome Statute into law & therefore has agreed to surrender all suspects for trial upon request.

 

Construction of Belo Monte is currently:

• in violation of the United Nations ILO Convention 169

in violation of the right to free, prior and informed consent guaranteed to the indigenous peoples who are affected by the project, due to the authorization of Belo Monte by Brazil's National Congress by means of Legislative Decree no. 788/2005.

• in violation of Article 231 of Brazil's Federal Constitution, which established the permanent right of the indigenous people to live in traditional territories & have exclusive use of natural resources to maintain their physical & cultural survival.

• in breach of The World Commission on Dams framework and ignores the IFC guidelines & the OECD recommendations for responsible business

• in violation of the Inter American System of Human Rights [IACHR] precautionary measures, which asked Brazil's government to stop the dam construction immediately, to protect the rights of life & health of the affected people. Brazil's government responded aggressively in response to this IACHR request.

• the subject of 32+ local legal cases against Belo Monte which are currently in the Brazilian Judicial system and are all experiencing ongoing delays or legal tool 'suspension of security'. The Brazilian courts have failed to maintain impartiality between corporate & government interests and the laws being violated.

• the cause of multiple conflict deaths of indigenous people fighting the Belo Monte dam construction, to date.

The tribes affected by Belo Monte & due to be affected once the 4 dams upstream are built to ensure Belo Monte's efficiency.  The Xingu River is home to over 25,000 indigenous peoples from 18 ethnic groups, including the Juruna, Xikrín, Arara, Xipaia, Kuruaya, Parakanã, Araweté, & the Kayapó.

The situation that allows the final stage of the dam to progress, is based on the construction consortium meeting licensing obligations.  Two such obligations involve the requirement to relocate the entire city of Altimira, which has been devastated by the hydrodam construction swelling the population, decreasing their food supply so drastically that people are starving, giving up their children and being severaly exploited.  Another licensing requirement provides that an adequate water treatment system be installed.
 
The financial burden of meeting these costs and obligations is so high and unrealistic, that it would appear the Brazilian congress are trying to change the constitution, which may diminish compensation, reparation and duty of care requirements established by previous licencing orders.  
 
The benefit of such onorous obligations is that it has bought some more time before the artifical canals can be flooded, in order to advance the SQP-ICC case profile.  The obvious fact remains however, that the government are determined to see the dam completed with billions already invested and it is likely legislative shortcuts and human rights violations will escalate to achieve this end, unless this SQP-ICC legal context and the Victory Amawon campaign and case can finally and permanetly stop Belo Monte.

              The declaration of independence of the Amazon is the right of the Indigenous people of these ancentral lands and provides a mechanism for the world to support the protection of the rainforest ecosystem from further development.  Join SQP in facilitating the indigenous tribes of the Amazon, in their declaration of independence as a new nation state, formally declared under legislative requirement to Ban Ki-Moon of the United Nations.  Securing this right, under international law to local people's soverign nation state and autonomous governance, can protect the rainforest ecosystem for the world, by enforcing an international moratorium against the thousands of new dirty industry developments advancing.  The return of this land to the guardianship of it's ancestral people, is possible on the basis of the 1933 Montevideo Convention, the 1960's United Nations General Assembly Resolution 1514 (XV), Article 5, 1541 (XV), Article 3 and the UN Millenium Declaration 2000.  Additionally, Article 11 of the UN plan to integrate the 1960's resolution 1514 (XV), requires that the current administrators of the indigenous lands must safeguard and gaurantee the protection their natural resources in the indigenous interests, which means under current circumstances, all contaminating industry should cease in the Amazonia rainforest.

LAW to PREVENT GENOCIDE  

     of a few hundred thousand  indigenous & river people across South America

currently attempted & planned

by the corporate directors

& executives of large multi-national

There is an International Court, a law & a punishment that can include up to 30 years

inprisionment, which actually allows for large hydrodams & other destructive developments to be stopped, if they will destroy the lives of the indigenous people by contaminating their eco & river systems. This legal statute is like discovering a hidden treasure, which we can now use to demand justice directly against those corporate & government decision-making men & woman, who are pursuing gross voilations of human rights & environmental destruction to the detriment of all people.  This law can protect the indigenous people & rainforests from the corruption of their 

own judicial system, government, 

corporations & private shareholders when in pursuit of profit in violation of multiple international & national laws, treaties, conventions & guidelines. 

 

 

The Law that offers a Solution...

 

This law itself is.  Article 6, Definition C of the Rome Statute of the International Criminal Court, to "prevent the Crime of Genocide against the indigenous people", the corporate & government decision makers progressing the construction of the industrial development "Deliberately inflicting on the group, conditions of life, calculated to bring about its physical destruction in whole or in part", with both the "intent" & "attempt" to destroy the indigenous group in this way.

 

The deprivation of resources needed for the indigenous group’s physical survival, such as clean water & food, have been 'calculated' by multiple scientitsts, to predict the physical destruction of the environment and tribes of the Amazon Jungle.

 

The "intent" to destroy the indigenous groups in this way is defined within Article 30 of the Rome Statute as the decision makers "meant to engage in the conduct" and that they either "meant to cause the conseqence or are simply "aware that the consequence will occur in the ordinary course of events".  Therefore the building of the hydrodams in pursuit of private profit & energy, has the consequence of destroying the resources that sustain the life of the indigenous people.  The "intent to destroy" is not required to be malicious intent against the people but rather simply an awareness & knowledge that there is a circumstance and conseqence, which will cause this harm & destruction against them, as a result of the industrial development.

 

The definition constituting the acts of the crime is also very generous within Article 25 of the Rome Statute.  The perpetrating individuals can "order, solicit or induce" the building of the dam, which can simply be "attempted"; their "purpose can be to facilitate, aid, abet, provide means for, otherwise assist or in any other way contribute to the attempted commision of the crime".

 

 

The evidence must illustrate that the perpetrators inflicted these conditions of life by conduct which took place in the context of a manifest pattern, which "was conduct that could itself effect such destruction".  The orders of the companies to progress the dam construction, or equipment, secure finance, provide finance, apply for licensing, etc... are all proof of the manifest pattern or statements and orders which constitute conduct which progresses the dam, with the "knowledge" of the effect being that of the environmental destruction which affects the indigenous habitats by contamination of the water.

 

Article 33 of the Rome Statute confirms that the corporate decision makers are not relieved of personal criminal liability because they committed the acts pursuant to a government order, which means the government vote in congress & the government licensing of the dams, does not absolve the financiers & constructors of criminal liability.

 

Article 21 profiles that the court recognizes not only the Rome Statute but also all international laws, conventions, treaties & guidelines that exist internationally that may be relevant to the case.  

 

Article 25.f is unique with regards to criminal law, where if a person abandons the effort to commit the crime or otherwise prevents the completion of the crime voluntarily & completely, then they shall no longer be liable for punishment & yet, anyone who does not voluntarily give up their action, will remain criminally liable, even in the event that the crime ceases to complete.  Therefore, the Victory Amazon campaign has the unique opportunity to leverage parties involved, to abandon their investment & construction in the dam, that will cause the effective genocide of the indigenous people by contaminating the resources that sustain their life in the jungle.  Those who do not abandon will remain criminally liable for their "attempt" to commit the crime, even if the dam finally fails to progress.

 

The context for the ICC Rome Statue, refers to our need for "consciousness" with regards to the "delicate mosaic" of "common bonds", "cultures" & "shared heritage",  "that may be shattered at any time".  Setting the tone of the Rome Statute & the ICC as a "protector of culture & heritage".  Therefore, protecting the tribes of the Amazon should be considered a priority by this court.

Kofi Annan’s 5 point framework on preventing genocide, provides that we take advantage of the "early and clear warning that allows the information gathering" necessary to prevent genocide and that the world utilises every opportunity to "end impunity through judicial action in international courts" with "swift and decisive action".  If the ICC approve & prioritize this prosecution with an immediate pre-trial hearing, then we can achieve this.

SQP & co-operating partners are forming the basis of an application to UNESCO MAP & BISOSPHERE program, to formally demarcate the indigenous lands & rivers which the 'prevention of genocide' law could indefinitely protect from environmentally destructive development.

 

Ultimately, the rainforests would secure investment for the installation of 

SATELITTE SURVEILLANCE

systems financed, which would allow the real time monitoring

of rainforest lands, for identification of unconsented entry & activity in the jungle such as illegal gold mining & land clearing.

 

 

PROTECT the RAINFORESTS

utilising the ICC Prevention of Genocide Law

to demarcate the indigenous lands that cannot be developed with hydrodams, mines or industrial developments if these would 

contaminate or destroy the people's clean 

water or food source, block land access 

or force relocation for corporate or 

government land expropriation. 

 

Once the land is demarcated, utilising the prevention of genocide law to formalise this protection, then the corporate directors & executives of large multi-national corporations planning or attempting any future destructive development, would be aware of the genocidal acts against the indigenous people that their decisions would cause & may be more likely to avoid taking on this liability. If continuing with contaminating development on these lands, they would then do so, knowing that they can be charged with the crime of Genocide.

 

 

# our greatest challenge has been to secure the finance that enables us to transition the voluntary team into full time roles, in order to complete the case submission to the court; applied alongside case profiles developed by multiple other NGO's who have been invited to contribute independent evidence modules against different indivdual accused parties.
